Brad Kane Mediation

With more than 30 years "in the trenches" of litigation and countless successful mediations, Mr. Kane is rarely surprised. As your mediator, he knows how to frame and communicate each parties’ relative strengths and weaknesses in order to reach creative solutions to even the bitterest disputes.

A Proactive Mediation Process

Our process is clear, effective, and transparent:

    Pre-mediation meeting with counsel to discuss overcoming settlement obstacles.
  2. 2
    Analyze mediation briefs, supporting evidence and address key issues or facts.
  3. 3
    Parties exchange draft documents with goal of getting signatures on long-form documents at mediation.
  4. 4
    Parties submit final drafts and supplemental briefings with goal of reaching a resolution.
  5. 5
    If parties cannot resolve the case, I will outline the steps necessary to create a settlement.

Mediation Services

Mediation Consulting is helping the attorneys: (i) get the case into a mediation posture; (ii) prepare an effective mediation presentation; (iii) overcome Opposing Counsel’s reasonably anticipated evidence and arguments; and (iv) develop a meaningful settlement strategy.

Mediation Coaching is real time assistance for the attorneys, while they are actually in the mediation.

Flavors of Mediations: Standard, Baseball – High Low, Mediation that converts to Arbitration with the mediator/arbitrator empowered to pick either the settlement offer close to the mediator’s value or impose a value.

Rates

Mediation: $4,000 for ½ day; $7,000 for full day.
Mediation Coaching & Consulting: $750/hr, Lawyers only.
Rocket Docket: $2,500 for 3hr session, Cases Under $75k only.

Professional Experience

Prior to founding the Kane Law Firm, Mr. Kane practiced at leading litigation firms such as Mayer, Brown & Platt and Christian, Miller, Fink, Jacobs, Glaser, Weil & Shapiro.  He successfully litigated cases involving multi-hundred million dollar failed savings and loan cases, as well as multi-million dollar ERISA actions, pension claims and employment disputes.  His practice also includes multi-million dollar class-action claims, employment claims, construction defects, breach of commercial contracts and bad faith insurance litigation.

His appellate work includes successful appeals before the United States Circuit Court of Appeals for the Fifth Circuit and Ninth Circuit as well as appeals before the California and Alaska Appellate Courts. Brad also clerked for Chief Justice Jay A. Rabinowitz for the Alaska Supreme Court after attending Hastings College of Law.

Community

Brad Kane is deeply involved in his local community. He has been president of the South Carthay Neighborhood Association since 2007, and he is in his eighth year as president of the PICO Neighborhood Council.
